General information
These General Terms and Conditions govern the relationships in connection with the procedure for concluding, amending and terminating contracts under the terms and conditions of Chapter IV, Section I "Off-premises and distance contracts" of the Consumer Protection Act through the Online Store www.gix.bg located at the electronic address www.gix.bg, as well as the terms and conditions for using the Online Store Araya 13 EOOD for the territory of the Republic of Bulgaria, between:

The person within the meaning of Art. 1.1. of these General Terms and Conditions, who uses the Online Store gix.bg and/or wants to conclude a distance contract, hereinafter referred to as the USER,
For the avoidance of doubt, the Online Store gix.bg, located at the email address http://gix.bg/ , is administered by Araya 13 Ltd.
Online store gix.bg serves as a virtual platform for offering and selling a wide range of goods
The USER agrees to these general terms and conditions of the TRADER, accepting them unconditionally and assuming the obligation to comply with them. The TRADER reserves the right to unilaterally update, supplement or change these General Terms and Conditions, as well as the structure of its website, the TRADER is obliged to notify the USER of changes to these GENERAL TERMS and CONDITIONS according to Art. 147b of the Law on the Protection of Personal Data.
1. General terms and conditions
1.1 In order to shop and use all services of the MERCHANT's Online Store, the USER must be a natural person (18 years of age or older) or a legal entity or other legal entity, and must have registered voluntarily and free of charge through the registration form. Registration requires the USER to correctly provide their data, which includes: name and surname, address, telephone number, e-mail address and password, if necessary, data of a legal entity for issuing an invoice. The USER can shop as a GUEST /without registration/, but cannot use the credit shopping service.
1.2 The MERCHANT requires the USER, when purchasing goods and services from the Online Store gix.bg- http://gix.bg/ for another Recipient, to provide the relevant data of the Recipient. The MERCHANT requires the provision of correct data in order to provide quality services. It is desirable for the USER to fill in the names and delivery address in Cyrillic.
1.3. Upon successful registration, the USER will receive confirmation of the username at the e-mail address provided by him, with which he will be able to log in and use the created profile in the MERCHANT's Online Store.
1.4. In case of incorrect and/or inaccurate data, the MERCHANT reserves the right to cancel the created profile.
1.5. In the Online Store gix.bg- http://gix.bg/ , in accordance with Art. 47 of the ZPA, each product contains the following information: item name, brand and model, main functionalities and characteristics; final price of the product in BGN /VAT included/, delivery price.
1.6. The MERCHANT provides, at its discretion, additional consumer information for the USER to be more fully informed when choosing a purchase.
1.7. THE MERCHANT reserves the right to change prices without prior notice to the users. THE USER or the final Recipient pays the price valid at the time of the order.
1.8. THE MERCHANT reserves the right to terminate, change, extend or permanently discontinue the PROMOTION at any time by publicly announcing this on the gix.bg website. products according to the technical specifications given by the Manufacturer.
- Ordering goods and services , concluding a contract
2.1. The USER can purchase goods online from gix.bg - gix.bg after logging into his/her profile via the "Login" link with his/her e-mail address/username and password. The USER can also shop as a GUEST by entering the necessary delivery data in the order form: name and surname, address, telephone number, e-mail address.
2.2. The USER selects a specific product with a minimum value of 8.00 leva by clicking on the "BUY" button available when viewing the product. Pressing this button saves the selected product in a virtual user basket.
2.3. The USER can view the contents of the cart, add new products or remove already added ones.
2.4. The USER confirms his order by clicking the "CONTINUE" button. In case he does not add new data for the delivery address or another Recipient, the MERCHANT accepts by default the delivery address specified in the data during registration.
2.5. The USER must confirm that he has read the General Terms and Conditions and accepts them, otherwise he cannot complete his order.
2.6. When an order is placed, it is registered and the USER receives a message at the e-mail address specified by him in the registration with summarized data about the order placed: order number, selected products, unit value, delivery price, total value of the order, delivery address. The message about a registered order with the summarized data about it is not an acceptance or confirmation of its execution. Until the confirmation of the order, which occurs by sending an email for a sent order with an attached invoice, the TRADER has the right not to fulfill the order in whole or in part due to reasons beyond his control and under these general terms and conditions, of which he notifies the user by email.
2.7. If an order is placed and registered with a model of a product whose unit value is less than ten leva, the same may be canceled by the MERCHANT.
2.8. In case of a registered order with more than three pieces of a model of the respective product/item, the MERCHANT will confirm the allowed quantity. For confirmation or not of the remaining pieces, the USER will receive an additional message.
2.9. In case of incorrect and/or inaccurate data of the USER or final Recipient, the MERCHANT will cancel the received order, which automatically terminates the Distance Selling Agreement.
2.10. The distance selling contract between the TRADER and the USER is considered concluded from the moment of confirmation of the specific order by the Trader with an email for a sent order with an attached invoice, which results in an obligation for payment by the USER for the goods purchased by him online.
2.11. The registered USER has the opportunity to store and monitor in his/her profile chronological information about purchases made in the past and current orders.
2.12. All goods, including those on sale, promotion/discount, are sold and delivered while supplies last, even if this is not explicitly stated on the site.
2.13. If the ordered products are out of stock, the MERCHANT must notify the USER, specifying additional ordering options and an approximate delivery time.
2.13. THE MERCHANT reserves the right to cancel an order in case of violation of any of these general terms and conditions, by promptly notifying the USER thereof.
2.14. Upon written inquiries and opinions received through the TRADER's contact form, an opinion or response is issued to the USER, after verification, within 14 days.
2.15. In the event of a complaint filed by the USER, the TRADER is obliged to bring the goods into compliance with the sales contract within one month from the moment of receipt of the complaint.
- Payment methods
3.1. THE USER has the option to pay for the ordered goods via:
- Cash on delivery - in cash upon delivery (when delivered by ECONT courier, a receipt is not issued according to REGULATION No. H-18 OF DECEMBER 13, 2006 ON REGISTRATION AND REPORTING OF SALES IN COMMERCIAL FACILITIES THROUGH FISCAL DEVICES)
3.2. All payments are made in Bulgarian leva, regardless of the type of payment.
3.3. The USER pays the invoice value of the purchased goods, including the price of delivery /except when a free delivery promotion is announced/. When purchasing credit, a verification fee of 6 BGN is paid.
3.4. Through a voluntarily chosen payment method, the USER makes a payment to the MERCHANT for the purchased online goods.
3.5. Depending on the selected payment method, the USER receives the relevant information regarding the payment /bank payment details, reference to electronic terminal payment, ATM payment instructions, cashier payment instructions/
3.8. The USER has the right to select more than one item or group of goods with a total value equal to the minimum credit threshold for each individual company.
- Delivery
4.1. Deliveries are made only within the geographical territory of the Republic of Bulgaria.
4.2. Delivery is made through a courier company with which the TRADER has a contractual relationship or through the TRADER's transport. In the event of the USER's personal choice of a courier company with which the TRADER has no contractual relationship, the announced terms of delivery and complaints are not valid.
4.3. The delivery price is included in the total invoice value, except when the MERCHANT has announced preferential terms with free delivery.
4.4. The delivery price is from 5.00 BGN to an ECONT office throughout the country for orders worth up to 119.00 BGN and FREE for orders worth over 500.00 BGN to an ECONT office, except when the MERCHANT has announced preferential terms with free delivery.
4.4.1. The delivery price is from 4.60 BGN to a Speedy office throughout the country for orders worth up to 119.00 BGN and FREE for orders worth over 500.00 BGN to an Econt office, except when the MERCHANT has announced preferential terms with free delivery.
4.5. Orders are delivered to the customer's address /to the entrance of the building, if access is provided, to the property boundary/ or to an office of a courier company.
4.6. Goods ordered through the Online Store Araya 13 Ltd. - gix.bg- http://gix.bg/ are delivered by a courier or by an employee of the MERCHANT within 1 to 5 business days, depending on the availability of the ordered product.
4.7. The specified deadlines apply according to the announced schedules of the courier companies for remote settlements and official holidays, when deliveries are made by the courier companies.
4.8. In the event of a delay in delivery, the TRADER is obliged to notify the USER, regardless of the reasons for the delay.
4.9. THE MERCHANT is not responsible for any delay caused by the actions of a courier or courier company.
4.10. The goods are handed over to the USER/RECIPIENT against a signature, which certifies that the MERCHANT has fulfilled the order.
4.11. The USER/RECIPIENT inspects the delivered goods for transport damage or other damage and files claims in the presence of a courier or person delivering the shipment.
4.12. By signing the acceptance document, the USER authorizes the courier to transfer on his behalf to the MERCHANT the amount of the total value of the invoice for the delivered goods, if the cash on delivery payment method is selected.
4.13. If the USER cannot be found at the specified delivery address by the courier company, through no fault of the MERCHANT, the person making the delivery leaves a message with a contact phone number, which the recipient should call within 24 hours to clarify a second delivery attempt.
4.14. In the event that the USER does not contact to specify the delivery, the distance selling contract is automatically terminated and the TRADER is released from the obligation to deliver the order.
4.15. In the event that the USER refuses to accept the ordered goods, the distance selling contract is automatically terminated and the person making the delivery returns it to the TRADER.
4.16. The risk of loss or damage to the goods passes from the MERCHANT to the USER/RECIPIENT at the moment when he or a person designated by him, other than the carrier, accepts the goods.
- Complaints and withdrawal from a distance sales contract
6.1. Upon receipt of the goods, the USER/RECIPIENT is obliged to immediately inspect it, and in case he finds visible defects such as: broken integrity of the packaging, cosmetic transport defects, lack of accompanying accessories, lack of accompanying documents /any of those required by Bulgarian legislation/, immediately inform the person carrying out the delivery.
6.2. In case of defects or missing parts in the package, in the presence of the courier or the person carrying out the delivery, a report is drawn up and the USER/RECIPIENT refuses to receive the shipment. The USER sends photos of the defects of the device, photographs of the transport packaging from all sides and submits claims for a complaint in writing to the following email address: araya13eood@gmail.com
6.3. In the event that the USER/RECIPIENT does not inspect the received goods and does not make immediate claims to the person making the delivery, the goods are considered approved, and the consumer loses the right to claim at a later stage.
6.4. In case the USER has chosen of his own free will a courier company with which the TRADER does not have a contractual relationship for the delivery of his order or has assigned such a company to return the goods back to the TRADER, the risk of loss or damage to the goods is entirely at the expense of the USER in accordance with Art. 103, paragraph 2 of the ZPA. The USER shall make claims against the carrier chosen by him.
6.5. The USER, who has the status of a consumer within the meaning of the Consumer Protection Act, has the right, on the basis of Art. 50 of the Consumer Protection Act, to withdraw from the concluded distance contract without owing a penalty or compensation within 14 days from the date of receipt of the goods, pursuant to Art. 50, item 2a, b.
6.6. The USER shall inform the TRADER in writing of his/her decision to withdraw from the sales contract before the expiry of the 14-day period under Art. 50 of the Consumer Protection Act, and the TRADER shall send the USER immediate confirmation of the received application for withdrawal from the sales contract.
6.7. The USER returns the goods to the TRADER within 14 days of submitting the claim and pays the transport costs for returning the goods under Art. 55, para. 2 of the ZPA. 6.8. The TRADER shall refund the amount paid by the USER for the purchased product, including delivery costs /if any/, within 14 days from the date of notification of the USER's decision to withdraw from the sales contract, using the same means of payment used by the USER. If the USER fails to comply with the deadline for returning the goods, the TRADER shall withhold the refund of the amount paid until the goods are received back from the consumer.
6.9. On the basis of Art. 55, para. 4 of the ZPA, the TRADER shall refund to the USER the reduced value of the purchased goods. The TRADER shall deduct 15% from the amount paid and refund to the USER the residual value, including the delivery costs, when the goods are in poor commercial condition /damaged or missing packaging/; the TRADER shall deduct 25% from the amount paid and refund to the USER the residual value, including the delivery costs, when the goods have been tested /in order to establish the nature, characteristics and proper functioning/.
6.10. The right to withdraw from a distance selling contract within 14 days under Art. 50 of the Consumer Protection Act does not apply to products related to hygiene requirements and health protection. In connection with Art. 57, item 5. of the Consumer Protection Act, the TRADER does not refund the amount paid for a used or tested product, in order to establish the nature, characteristics and proper functioning. Goods related to hygiene are: headphones-earplugs, products whose main use is related to direct contact with the body.
6.11. The right to withdraw from a distance selling contract within 14 days under Art. 50 of the Consumer Protection Act does not apply to sealed information products, software, video recordings and sound recordings. In connection with Art. 57, item 9 of the Consumer Protection Act, the TRADER does not refund the amount paid for a used or tested information product, in order to establish the nature, characteristics and proper functioning. Such goods are: digital media, portable memory, computer games, DVDs, CDs, unrecorded video cassettes, batteries.
6.12. The TRADER does not refund delivery costs if the USER has voluntarily chosen a different supplier than those offered by the TRADER with whom he has a contractual relationship.
6.13. In the event of the circumstances specified in items 6.1, 6.2 and 6.3, such as damage or loss of the goods, the MERCHANT does not refund the amount paid for the goods and all related costs.
Return conditions
The product can be returned within 14 days of delivery.

Return shipping costs are covered. FROM THE BUYER . Return of the product itself will be subject to the following conditions:
1) The product must be unused and unopened, without any external signs of use.
2) The integrity of the product must not be compromised - it must be sent back to us in the condition in which it was received.
3) Its packaging must not be damaged (crumpled, stained, torn, torn, taped).
4) There should be no signs of use, scratches, or impacts on the product itself.
5) No missing accessories - if any are sent with the order itself
If the above conditions are not met, we reserve the right to refuse a return.
CONDITIONS FOR RETURN/RECLAIM OF PURCHASED GOODS
The return period is 14 /fourteen/ days, starting from the date of receipt of the goods. In addition to the return form for purchased goods, the returned shipment must include proof of purchase (a document from a courier or a printout on the merchant's website). It is a mandatory condition that the purchased products are in good commercial condition, without damaged packaging and without being used (unsealed cellophane or a torn box is considered a violation of the integrity of the packaging). The goods can be returned to the company's office by courier. Transportation costs are at the expense of the Customer and are not refundable. Shipments sent by cash on delivery are not accepted. After receiving the returned goods and examining them (information about which will be sent by e-mail or phone), the value excluding shipping costs will be refunded to the Customer - to a bank account within 14 days. Goods whose return/complaint cannot be accepted (e.g. if sent after the specified deadline, if not accompanied by a document, if unpacked, etc.) will be sent back to the Customer at his expense. If for some reason the Customer has made a mistake and has specified a different product than what he wanted and has not identified his mistake by the time the order is sent, he can contact the company's office to decide how to proceed. Each case is considered individually. The costs of returning a product and sending a new one are at the expense of the Customer. If the new order is more expensive, the difference will be paid. The Supplier has the right to refuse the return of a product at its discretion if circumstances require it. Any product that does not comply with the order requested by the Client is subject to a claim. The Client may refuse it upon receipt from the courier and not accept it from him. In the event of a clear discrepancy between the received product and the order, immediately contact us at one of the telephone numbers listed on the site. The discrepancy is checked by the name of the product in the order and the name of the product that the Client received. If such an error is detected, the Client returns the product at the expense of the Supplier and the correct one is sent to him. A claim is not subject to a claim for a product for which the Client has been previously warned of a discrepancy or defect, as well as for products whose discrepancy is due to materials provided by the Client. If, upon receipt of a product, it has damaged or torn packaging, the claim will be honored only in the presence of the courier upon receipt of the product. In this case, immediately contact us by phone or make a claim to the courier. The claim is certified by an entry on the waybill by the recipient at the time of receipt of the shipment. Claims relating to mechanical damage, arising during transport will be considered only on the basis of a complaint protocol drawn up in the presence of the courier. In case of visible damage to the shipment at the time of its delivery, a report of findings is prepared (in two identical copies), which describes the observed condition of the shipment and its packaging. In this case, the Client may refuse to receive the shipment or take it under his/her own responsibility. In case the Client accepts such a shipment and does not file his/her claims with the courier upon receipt, the responsibilities for the claim are transferred to the courier who delivered the shipment to the Client. In such circumstances, the conditions for claims for shipments of the respective courier company apply. When filing a claim within 14 working days from the date of purchase, provided that all the terms of the store and all applicable legal provisions are met, the Client may claim a refund of the amount paid, exchange the goods for another or a discount on the price. All costs incurred by the Client for receiving and returning the purchased goods, bank commissions and other costs beyond the amount of the value are at the expense of the Client. A person who is a third party upon receipt of the shipment and is not the primary payer for it has no right to claim.
RETURN/COMPLAINT SERVICE
Complaints are handled in the order described below. Filling out a return/complaint form with a detailed statement of the reasons for the return/complaint . After receiving the form, the Supplier returns a response to the Customer to a valid e-mail address. The Supplier reserves the right to not accept the Customer's finding if it deems that his reason for return/complaint is unfounded or is a result of improper use by the Customer. In case the received form does not make clear the reasons for the complaint, the Supplier shall notify the Customer of his rights in an appropriate manner /telephone or valid e-mail/ The Customer shall return the purchased product in a manner convenient for him and at his own expense to the company's office. It is important that the shipments are well packaged. For each product returned with a complaint, a report of findings is drawn up and after examination, a statement is filled out with acceptance or rejection of the complaint. The period for which the Supplier must issue a statement to the Customer within the statutory period – up to 10 /ten/ days after submitting a complaint. After the report of findings is drawn up and the complaint is accepted as justified, the Supplier notifies the Client by phone or e-mail and takes the following actions to service the complaint: 1. Sends the Client a new product of the same type at its own expense 2. In the event that the same product cannot be secured, offers options for choosing another product of the same value 3. In the event that the same product cannot be secured, the Supplier refunds the value to the Client in the legally established manner. When rejecting the submitted complaint and completing the report of findings, the Supplier notifies the Client of its opinion by sending a copy of the report of findings to the e-mail address specified by the Client. The Client notifies the Supplier by phone or e-mail about subsequent actions regarding the product under complaint. When requesting a return, the product and the report of findings are sent to the Client in a manner convenient for him, with the costs of receipt being at his expense. If within 30 /thirty/ days after notification, the Customer does not claim his goods, the Supplier reserves the right to dispose of the goods as it sees fit and does not owe any amounts, both for the value of the products and for the costs incurred for them, to their original owner.

Consent to the processing of personal data is required only in the absence of another basis for data processing - for example, a contract, a special provision of law, the legitimate interest of the administrator, etc.
The categories of personal data that gix.bg processes for you are as follows:
- For accounting and tax purposes – names, personal identification number, address;
- For the purposes of service and warranty maintenance of the goods - names, address, contact telephone number;
- For the purposes of video surveillance for security purposes - recordings;
- For marketing purposes when participating in games and raffles - names, date of birth, address, contact phone number, email address.
- For the purposes of registered online applications and accounts: Name, address, telephone, email address. For the purpose of processing online credit applications - name, address, telephone, email address and personal identification number, required by the respective credit company.
The data retention periods are determined as follows:
- For accounting and tax purposes – in accordance with applicable legislation;
- For the purposes of service and warranty maintenance of the goods - in accordance with applicable legislation;
- For the purposes of video surveillance for security purposes – 2 months;
- For marketing purposes when participating in games and raffles - until the end of the marketing campaign.

gix.bg does not provide data about its customers to third parties, except when required by express provisions of law, for example for the purposes of preventing, investigating, detecting or prosecuting crimes or executing imposed penalties, including the protection against and averting threats to public security.
gix.bg does not provide data about its customers to a third country or international organization.
As customers of gix.bg, and in your capacity as data subjects, you have the right to request from the administrator access to, correction or deletion of your personal data or restriction of the processing of personal data relating to you, or the right to object to the processing, as well as to exercise the right to data portability.
In cases where your personal data is processed on the basis of your informed consent, you have the right to withdraw it at any time, keeping in mind that the withdrawal of consent has effect for the future.
The provision of the specified volume of personal data is mandatory in cases where they are necessary to fulfill legal requirements or are related to the performance of a contract.
gix.bg does not apply automated decision-making, including profiling, with respect to the personal data of its customers.

- Purchasing goods on individual request
8.1. The USER can purchase goods online from www.gix.bg after logging into his/her account via the "Login" link with his/her e-mail address/username and password. The USER cannot shop on request as a GUEST.
8.2. When purchasing goods on an individual request, the USER provides a financial guarantee by paying for the goods ordered in advance in full.
8.3. When purchasing goods on an individual request, the USER accepts in advance and agrees with the conditions in connection with Art. 57, item 1 and item 3 that he loses the right to withdraw from the distance sale within 14 days.
8.4. The goods offered on individual request are not available and are delivered within an individual deadline. The USER can receive information about the approximate delivery time by making a request through the contact form: araya13eood@gmail.com .
8.5. The procedure for purchasing (ordering) goods by individual request and delivery is as follows:
- THE USER selects a product upon request and contacts via a contact form or by email inquiry: araya13eood@gmail.com to receive information about the delivery time. Within 24 hours, the customer receives an email with which the MERCHANT confirms or not the order and the delivery time.
- in case the USER agrees with the delivery time, he/she logs in through his/her profile via the "Login" link used on araya13eood@gmail.com and places an order for the selected item on request
- the USER receives an automatic message about the order placed and bank payment details at the email address specified in the registration
- when the purchased goods on an individual request have been delivered by the manufacturer and are already available, the operator of the Online Store Smart Mall BG EOOD contacts the USER for delivery details
- delivery is made within 7 days after production and delivery of the goods to the MERCHANT
- delivery is carried out via gix.bg transport or through a courier company, with the authorized person handing over the goods to the USER against a signature, which certifies that the MERCHANT has fulfilled the order
- The USER must inspect the delivered goods for transport damage or other damage and submit claims in the presence of the courier or the person delivering the shipment.
- in case the USER establishes a transport or other visible defect, he/she must require the courier or the person delivering the goods to draw up a report and refuses to accept the shipment. Establishes contact with the operator of the Online Store Araya 13 Ltd. and specifies whether he will wait for a new delivery, or wishes to be refunded the amount paid.
- in case the USER does not inspect the received goods and does not make immediate claims, the goods are considered approved, and the consumer loses the right to claim at a later stage.
8.6. In the event of a delay in delivery, the TRADER is obliged to notify the USER, regardless of the reasons for the delay.
8.7. THE MERCHANT is not responsible for any delay caused by external circumstances and reasons beyond its control.
8.8. Araya 13 Ltd. provides a 24-month warranty for all products offered on the site, in accordance with the Consumer Protection Act.
